Maricopa vs Pinal septic permits

Arizona sets the rules for on-site wastewater systems and then delegates the administration to counties. In this service area that means two separate programs with their own forms, fees and review steps. Getting the county right is the first step in any septic project here, and it is not always as obvious as it sounds.

What is identical in both counties

Start here, because it is the larger part. A.A.C. R18-9-A316, the transfer of ownership inspection rule, is a state rule and applies statewide without variation:

• The seller retains a qualified inspector within the six months before the date of transfer.
• The inspector's qualification test is the same: working knowledge, an ADEQ-recognized training certificate, and a licence in one of the listed categories.
• The Report of Inspection covers the same things, including the default pump-out and its three exceptions.
• The seller hands the buyer that report plus the permitting, operation and maintenance documents in their possession, before the transfer.
• The buyer files a Notice of Transfer within 15 calendar days after the transfer.

So if you have moved between the counties, the rule you have to satisfy has not changed. The desk you deal with has.

What differs

Permitting and inspection of installations, and the receiving agency for a Notice of Transfer on a newer system. Maricopa County Environmental Services and Pinal County Environmental Health each administer their own program, and the practical differences show up in forms, fees, submission routes and review timelines.

Which county permits your system

Arizona delegates on-site wastewater permitting to counties, and the two in this service area run separate programs. Find your county before you start any paperwork.

Maricopa County

Permitting and inspections run through Maricopa County Environmental Services. Covers the unsewered Phoenix metro fringe: Buckeye, Cave Creek, New River, Rio Verde, the Surprise fringe and the Queen Creek edges.

Pinal County

Where the Notice of Transfer goes is a different question

It is not decided by county. Under A.A.C. R18-9-A316(E), a facility whose construction was completed before January 1, 2001 files with ADEQ, and one constructed on or after January 1, 2001 files with the health or environmental agency the Director delegated, which here means Maricopa County Environmental Services or Pinal County. Two houses on the same street can file in two different places.

The three traps

1. The city of Maricopa is in Pinal County

This is the big one and it catches people who have lived here for years. The county and the city share a name and nothing else. If your address is in the city of Maricopa, Pinal County Environmental Health permits your system, exactly as it does in Casa Grande.

2. Queen Creek straddles the line

The town lies mostly in Maricopa County with a portion extending into Pinal County, so which agency governs a parcel is a genuine question rather than an assumption. Confirm it from the parcel record before you file anything or hire anyone.

3. Metro address does not mean Maricopa County

Apache Junction and San Tan Valley both function as part of the Phoenix metro area and both are in Pinal County. A homeowner who moves a few miles east across the line and assumes the process is unchanged will be dealing with the wrong agency.

The filing fork, which is not a county question at all

Worth separating out because it is the step most often got wrong. Where a Notice of Transfer goes is decided by when the system was built, not by where it is:

• Construction completed before January 1, 2001: it goes to ADEQ, whichever county the property is in.
• Constructed on or after January 1, 2001: it goes to the delegated county agency, so Maricopa County Environmental Services or Pinal County Environmental Health.

Questions homeowners ask

Is the city of Maricopa in Maricopa County?

No. The city of Maricopa is in Pinal County, so Pinal County Environmental Health permits septic systems there. The county and the city share a name and nothing else. This is the single most common local error in this market and it catches long-time residents as often as newcomers.

Which county is Queen Creek in?

Both, in effect. The town lies mostly in Maricopa County with a portion extending into Pinal County, so which agency permits a given parcel depends on which side of the line it sits on. Confirm from the parcel record rather than from the mailing address, because the two do not always agree near a boundary.

Does the transfer inspection requirement differ between the counties?

No. A.A.C. R18-9-A316 is a state rule and it applies identically statewide. The six-month window, the inspection scope, the document handover and the 15-day filing deadline are the same in Casa Grande as in Buckeye. What differs is which agency receives the Notice of Transfer for a system built on or after January 1, 2001.

I have a permit from one county. Does it carry to the other?

A permit is issued for a specific property by the agency that governs it, so it is not something that transfers between counties. If you own property in both, treat them as two separate processes with two separate agencies, and expect the forms and fees to differ.

How do I find out which county my parcel is in?

From the parcel record, through the county assessor, rather than by inferring it from the mailing address. Rural addresses and postal routes do not always follow jurisdiction lines, and the boundary between these two counties runs through areas that read as a single metro region.
